The BNSF Railway Law and Claims Department provides expert in-house counsel and collaborates with outside counsel to ensure the railroad operates safely and meets all legal and contractual obligations. Our licensed attorneys and legal professionals are dedicated to upholding the highest legal compliance standards. The specialized Claims team promotes safety, investigates incidents, and resolves them ethically.

This is a full-time position located in Fort Worth, TX.

Relocation is not available for this position. The role will be performed at the current work location of the successful candidate.

Travel is occasional, but irregular, travel (averages less than 20%).

Shift/Hours include frequent evening, night and weekend work (including holidays), on call 24-hours a day, irregular hours of work.

This position is responsible for investigating and settling all claims and lawsuits involving the company, arising out of personal injuries or property damage, excluding bill of lading claims. This is a training and educational position designed for later advancement or claim representative position depending on experience.

Key responsibilities may include:

Provides back office support to field claims team response to incidents through the identification and securement ofperishable evidence items.
Actively
participates in investigations and provides guidance and support to responding field personnel.
Coordinates
on evidence requests with various internal & external partners, including mechanical, transportation, signal, andother railroads.
Utilizes
multiple technology platforms to locate and secure potentially relevant items.
Fulfills
requests from the field for various evidence items across a wide spectrum of records and databases.
Conducts
reviews of evidences for accuracy and completion; oversees files to ensure all relevant items are secured anduploaded, providing guidance and training to field teams as necessary.
Actively participates i
n the training, continuing development, and goal achievement of the Claims Team.
Special projects / assignments
as designated by the Director Claims or Manager, Claims Evidence Preservation.

INTERNAL CONTACTS: Mechanical, Signal, Transportation. Works closely with all BNSF departments to perform incidentinvestigations/analyses and promote the General Claims Department's Vision Statement with such other internaldepartments.
EXTERNAL CONTACTS:
Foreign railroad representatives, defense and plaintiff attorneys and expert consulting witnesses inspecialized fields.

Daily work is conducted in a mixed indoor office and outdoor safety-sensitive environment, where working conditions can include diverse and extreme weather conditions (hot, cold, rain, snow, and sleet), walking and performing work on uneven surfaces, and working around loud noises, fumes, and heavy/moving machinery. Personal protective equipment, a hard hat, safety glasses, and gloves are required and provided by BNSF.

Basic Qualifications:

  • Able to work now and in the future without BNSF's assistance (whether monetary, through sponsorship, or otherwise) in obtaining, maintaining, or extending employment authorization (including H-1B, STEM OPT/CPT, or TN nonimmigrant status).
  • Bachelor's degree.
  • Minimum 3 year experience at BNSF or in a related field (railroad claims, railroad, insurance, legal, investigative) or a combination thereof.

Preferred Qualifications

  • General knowledge of railroad operations and principles and/or insurance claims or related medical/legal field.
  • Knowledge and understanding of Federal Employers Liability Act (FELA).
  • Personal skills: aggressive work ethic; ability to communicate with individuals in every social, educational and economic level; an imaginative and inquisitive mind; ability to gather, weigh and analyze information; decision making capabilities; skill in photography, typing, and basic computer applications. Willingness to learn. Must be a self-starter and independent worker.
